Cannabis Laws in Idaho

As of April 2026, Idaho remains one of the most restrictive states for cannabis, with no legal medical or recreational program. However, in November 2026, Idaho voters may have the chance to change this.

Current Legal Status
  • Strict possession penalties: House Bill 7 signed into law in February 2025. From July 1, 2025, possession of 3 ounces or less is a misdemeanor, carrying a mandatory minimum $300 fine, and potential penalties of up to one year in jail and/or a fine up to $1,000.
  • Idaho has no decriminalization laws, no medical cannabis program, and no adult-use framework.
  • Industrial hemp (up to 0.3% THC) is legal to grow and transport under a state licensing program. However, CBD products sold in Idaho must contain 0.0% THC.
Medical Cannabis Ballot Initiative

The citizen-led effort named the Idaho Medical Cannabis Act, spearheaded by the Natural Medicine Alliance of Idaho, is currently working to qualify for the November 2026 ballot. This initiative would allow patients with qualifying conditions (such as PTSD, epilepsy, or cancer) to obtain medical cannabis with a doctor’s recommendation from state-licensed dispensaries. Initially, there would be only three licensed businesses with possible expansion to six in the future. By April 2026, already more than 100,000 signatures have been collected, well above the 70,725 signatures required.

According to a poll commissioned by the Natural Medicine Alliance of Idaho, more than 80% of Idaho voters support medical cannabis legalization.

Legislative Resistance

However, the path forward is challenging and opponents in the state legislature have placed a Constitutional Amendment (HJR004), on the same November 2026 ballot. If passed, it would amend the state constitution to grant the legislature exclusive authority to legalize or regulate any controlled substance. This would effectively block future citizen-led ballot initiatives on the topic.
