U.S. Cannabis Market Legalization
Although the use of cannabis is illegal under the federal law and the federal government classifies cannabis as a schedule 1 drug, 84% of the U.S. states have legalized it in some form. Most states legalized it only for medical purposes, but 24 states – Alaska (2015), Arizona (2020), California (2016), Colorado (2012), Connecticut (2021), Delaware (2023), Illinois (2020), Maine (2017), Maryland (2023), Massachusetts (2016), Michigan (2018), Minnesota (2023), Missouri (2022), Montana (2021), Nevada (2017), New Jersey (2021), New Mexico (2021), New York (2021), Ohio (2023), Oregon (2015), Rhode Island (2022), Vermont (2018), Virginia (2021) and Washington (2012) – have gone further, legalizing the recreational use.
As a result, 42 states, the District of Columbia, Puerto Rico, Guam, the Northern Mariana Islands, and the U.S. Virgin Islands have effective medical cannabis laws, and 24 states, the District of Columbia (2015), Guam (2019), the Northern Mariana Islands (2018) and the U.S. Virgin Islands (2023) now allow cannabis for recreational use.
U.S. Cannabis Market Stats
U.S. legal cannabis sales reached $17.5 billion in 2020 and grew to $25 billion in 2021 – comprising approximately $16 billion in adult-use sales and $9 billion in medical sales. Sales continued climbing to an estimated $27 billion in 2022 and nearly $30 billion in 2023. Growth then moderated, with the market stabilizing while still expanding modestly: retail sales reached $30.4 billion in 2024 and $31.3 billion in 2025. By this period, adult-use sales accounted for more than 70% of total market revenue, reflecting the segment’s expanding dominance.
Following a two-year contraction that reduced active U.S. cannabis business licenses by over 10%, the market stabilized in mid-2024, with counts holding near 40,000 through 2025. By early 2026, the total had settled at 36,665–37,555, reflecting continued market rationalization underway since 2023. This shift features a 24% decline in cultivation permits, partially offset by growth in vertically integrated operators and new retail licenses – particularly in emerging markets like New York.
Among major license types, cultivation and retail/dispensary licenses are by far the most prevalent, collectively accounting for over 70% of all active cannabis business licenses in the U.S. Manufacturer/processor licenses represent the third-largest category. Notably, vertically integrated operators demonstrated the strongest growth among all operator types during the period. Among smaller license types, consumption lounges surged nearly fourfold in the past 12 months, reaching 68 licensed venues.
U.S. cannabis employment grew from 211,000 in 2019 to 243,700 in 2020 (+17%). After adding 77,300 jobs in 2021 and 107,059 in 2022, the workforce peaked at 428,059 that year, dipped to 417,493 in 2023, then rebounded to a record 440,445 in 2024 (+5.4%).
In 2025, the U.S. cannabis workforce underwent a “strategic reset,” contracting by 3.4% to 425,002 jobs as the industry prioritized operational efficiency and regional growth in states like New York over national expansion.
