In 1976, Nebraska decriminalized the first-time possession of up to 1 ounce of marijuana.
2020: The Medical Marijuana Legalization Initiative, which would have legalized medical cannabis, was removed from the ballot through a ruling by the Nebraska Supreme Court even though it collected enough signatures.
2022: The Marijuana Legalization Initiative was introduced, seeking to legalize recreational cannabis in the state. However, it was not placed on the ballot.
In 2022, the Medical Marijuana Initiative was filed by the same sponsors as for the 2020 Medical Marijuana Initiative that was removed from the ballot. However, Nebraska law has a distribution requirement. This requirement states that signatures collected must include signatures from at least 5% of registered voters in each of 38 of Nebraska’s 93 counties. The initiative did not meet this requirement and therefore was not placed on the ballot.
2023: Legislative Bill 588 was introduced in January 2023 with the aim to legalize some forms of cannabis for medical use and create a framework for medical cannabis legalization. This bill was considered by the Judiciary Committee in February 2023 but no action was taken and on 18 April, 2024, it was indefinitely postponed.
Legislative Bill 634, seeking to legalize recreational marijuana for adults aged 21 years old and over, was introduced in January 2023. It was also indefinitely postponed on 18 April, 2024.
2024: Two initiatives appeared on the 2024 ballot.
The Medical Marijuana Legalization Initiative would enact the Nebraska Medical Cannabis Patient Protection Act which aims to legalize the use of up to 5 ounces of cannabis by qualified patients for medical purposes, provided they have a written recommendation from a health care practitioner.
Approved (Yes 70.62%, No 29.38%)
The Medical Marijuana Regulation Initiative would enact the Nebraska Medical Cannabis Regulation Act and legalize the possession, manufacture, distribution, delivery and dispensing of medical cannabis by registered private entities. It would also establish the Nebraska Medical Cannabis Commission to regulate the registration process and the registered entities.

On July 3, 2024, more than 114,000 signatures for each of the two initiatives were turned in. The campaign managed to meet the distribution requirement for both of its initiatives as the submitted signatures include signatures from at least 5% of registered voters in each of 38 of Nebraska’s 93 counties.
Cannabis Legalization in Nebraska
On November 5, 2024, Nebraska became the 41st state to legalize medical cannabis.
Measure 437 takes effect in December 2024 and legalizes the possession of 5 ounces of medical cannabis by a qualified patient provided they have a written recommendation from their health practitioner or by a caregiver for assisting a qualified patient.
Measure 438, though it also takes effect in December 2024, has several steps that have to be completed before there is a fully operational medical cannabis program.
The three commissioners of the Nebraska Liquor Control Commission will form the Nebraska Medical Cannabis Commission (Commission) and two more members will be appointed by the governor. By July 1, 2025, the commission should create criteria for applications for registered medical cannabis establishments. By October 1, 2025, it should start granting registrations to applicants who meet the established criteria.
In January 2025, two bills were introduced proposing regulations for Nebraska’s medical cannabis market – LB651 and LB677. As of May 2025, it is known that LB677 failed to pass the Senate.
Still, recently, there has been progress on the state of Nebraska’ medical cannabis regulations. On June 26, 2025, Governor Pillen signed into law emergency regulations for Nebraska’ medical cannabis program. Under the law, licensing must begin by October 1, 2025. The emergency rules are effective for up to 90 days, through September 28, and then can be extended for another 90-day period. Governor Pillen and members of the Commission plan to move forward with formal regulations by October 1.
On September 2, 2025, the Commission voted to amend the emergency regulations. The new regulations limit cannabis licenses to 4 cultivators, 4 product manufacturers, 12 dispensaries, and 12 transporters. Each cultivator would be allowed to grow up to 1,250 flowering plants. Permitted cannabis forms would include oral tablets, capsules or tinctures, gels, oils, creams, and other topicals. Smokeable and vaporizable cannabis as well as cannabis edibles will be prohibited. The new regulations also allow the Commission to start licensing registered medical cannabis establishments by October 1. The revised regulations were signed by Governor Pillen on September 9. Commissioners scheduled a public hearing on October 15 to receive feedback. After receiving public comments, the Commission still declined to make any changes to the draft cannabis regulations.
The application period for cannabis cultivation licenses opened on September 4 and closed on September 23, 2025. However, the October 1 deadline for issuing licenses was missed, as two of the five cannabis commissioners have resigned. The remaining commissioners will review the cannabis cultivation license applications, using metrics that have not been publicly released. On November 17, the two appointments were announced to replace the resigned commissioners. On October 7, the Commission issued two of the four cultivator licenses.
Analysts project that Nebraska’s medical cannabis market could generate over $925 million in new economic activity for local communities.
