For the first time, some patients in the US will have a formal pathway for accessing hemp-derived CBD products within a federal healthcare program. A new pilot program from the Centers for Medicare & Medicaid Services (CMS) will allow participating healthcare providers to provide hemp-derived CBD products to patients at no cost to the patient. CMS CBD Pilot Program

From April 1, 2026, under the Substance Access Beneficiary Engagement Initiative (BEI), participating organizations in ACO REACH Model and Enhancing Oncology Model (EOM) programs can obtain up to $500 worth of hemp CBD products per year, per eligible beneficiary, and give them to eligible Medicare beneficiaries enrolled in those programs. From January 1, 2027, the BEI will become available to participants in the Long-term Enhance ACO Design (LEAD) Model as well.
Hemp products are furnished and provided by a qualified physician affiliated with the participating organization to their patient. The providers themselves must cover the cost and procure the products. It should be noted that the beneficiaries cannot submit a Medicare claim for the hemp CBD products.
On the same day the BEI launched, FDA Commissioner Marty Makary issued a memo stating the agency “does not intend to enforce” certain provisions of the Federal Food, Drug, and Cosmetic Act against orally administered, hemp-derived CBD products, provided that the product:
- Is manufactured, marketed, and labeled in a manner consistent with the dietary supplement framework.
- Is not contaminated.
- Is not packaged or labeled in a manner that would be attractive to or marketed for children.
- Is provided to a beneficiary through a program of medical items or services payable under Title XVIII of the Social Security Act, under the direction of the patient’s treating physician, in a manner ancillary to the covered items or services furnished under such program.

Only hemp products meeting the specifications outlined in the table below can be provided to beneficiaries under the BEI.

One hemp product brand, Cornbread Hemp, has announced an exclusive contract with a Group Purchasing Organization (GPO) to serve as the exclusive hemp product supplier for 68,000 healthcare provider locations nationwide under the program. Another company, NuLeaf Naturals, has also stated that it is reaching out to participating organizations to participate in the program as a product supplier.
Businesses looking to participate in this program should first ensure that their products meet the eligibility rules prior to approaching any healthcare provider. This means having up-to-date certificates of analysis from third-party labs for every batch and ensuring that the business complies with all applicable state and local laws.
