The General Election is Tuesday, Nov. 3, 2020.

There were following ballot initiatives and results for Cannabis Legalization 2020:

Mississippi – voters approved medical cannabis through a ballot initiative. The state has until July 1, 2021 to establish rules and regulations. The initiative was designed to allow medical cannabis treatment for more than 20 specified qualifying conditions, allow individuals to possess up to 2.5 ounces of cannabis at one time, and tax cannabis sales at the current state sales tax rate of 7%.

South Dakota – voters approved recreational and medical cannabis legalization ballot measures. The medical cannabis initiative will make a statutory change to allow patients suffering from debilitating conditions to possess and purchase up to three ounces of cannabis from a licensed dispensary. The state Department of Health will have until October 29, 2021 to enact regulations for the program and then must issue patient registration cards by November 18.

Idaho – would set up a system of licensed dispensaries, growers, processors, and testers, and establish the maximum amount of cannabis qualifying patients and caregivers per assisted patient may possess is 4 ounces of usable cannabis and 6 cannabis plants if issued a registry identification card allowing cultivation.

Arizona – voters approved a proposition that legalizes recreational cannabis. Proposition 207 legalized the possession and use of cannabis for adults (age 21 years or older) in Arizona. The ballot initiative made the Arizona Department of Health Services (DHS) responsible for adopting rules to regulate cannabis, including the licensing of retail stores, cultivation facilities, and production facilities. Proposition 207 placed a 16% tax on cannabis sales, in addition to the existing transaction privilege tax and use tax.

Montana – voters legalized the possession and use of cannabis for adults over the age of 21, imposing a 20% tax on cannabis sales, requiring the Department of Revenue to develop rules to regulate cannabis businesses. The department would begin accepting cannabis provider and dispensary applications by January 1, 2022.

New Jersey – voters approved an amendment about recreational cannabis, with the effective date of January 1, 2021. The Amendment legalizes the possession and use of cannabis for persons age 21 and older and legalizes the cultivation, processing, and sale of retail cannabis. The state sales tax (6.625%) will be applied to recreational cannabis and the state Legislature was authorized to allow local governments to enact an additional 2% sales tax.

South Dakota – voters approved recreational and medical cannabis legalization ballot measures. Amendment A legalized the recreational use of cannabis for individuals 21 years old and older. Under the measure, individuals are allowed to possess or distribute up to one ounce of cannabis. The amendment required the South Dakota State Legislature to pass laws providing for a program for medical cannabis and the sale of hemp by April 1, 2022. Under the amendment, cannabis sales were set to be taxed at 15%.

Ohio (pending official review) – would allow individuals 21 years of age or older to possess, consume, purchase, or transfer one ounce of marijuana; to grow, manufacture, transport, or store six marijuana plants per household; and authorize marijuana retail stores.

Oklahoma – would allow people 21 and over to possess, cultivate, and purchase marijuana from licensed retailers. Possession would be capped at 1 ounce, and individuals could grow up to six plants.

Arkansas – would legalize marijuana use for residents 21 years of age and older.

Missouri – would allow people 21 and older to possess up to an ounce of weed purchased from a legal retailer with a 15% excise tax and/or grow up to three plants.
