The Senate Substitute for House Bill 2167, which establishes the state’s Commercial Industrial Hemp Program, was signed by Governor Kelly on April 15, 2019. Under the bill, license holders are able to grow, process and distribute industrial hemp within the state.

The state’s Hemp Plan was approved by the United States Department of Agriculture (USDA) in 2020.

Under current regulations, if the crop tests higher than the 0.3% THC regulatory limit it must be destroyed. There is a $225 testing fee for each sample collected and tested by the Kansas Department of Agriculture (KDA).

According to K.S.A. 02-3901, persons seeking to cultivate or produce industrial hemp must be licensed by the KDA as a commercial industrial hemp producer and persons seeking to process industrial hemp must register with the State Fire Marshal. License fee varies depending on the type: $1,200 for growers and $500-$1,000 for processors (fiber-CBD). There is also a $100 application fee and a $47 criminal history record check fee.

In 2020, the state of Kansas has approved about 9,903 acres in 71 counties for growing hemp comparing to 5,200 acres in 2019. 214 growers (248 in 2019) and 23 processor licenses were issued.

In 2021 and 2022, 540 and 980 acres were planted in Kansas according to the National Hemp Report.

40 growers planted 814 acres of hemp in 2023, down from a high of 3,968 acres planted in 2020 and an 18% reduction in planted acreage compared to 2022, according to the KDA. 83% of hemp in Kansas was planted for fiber.
