Medical Cannabis
Governor Jack Markell signed the Delaware Medical Marijuana Act on May 13, 2011, and it became effective on July 1, 2011. The Delaware Department of Health and Social Services (DHSS), Division of Public Health (DPH) is charged with implementing the Delaware Medical Marijuana Act that regulates the medical use of marijuana in Delaware. DPH’s Office of Medical Marijuana (OMM) operates the Delaware Medical Marijuana Program (MMP).
In June 2015, Delaware opened its first medical marijuana dispensary, the First State Compassion Center (FSCC) in Wilmington.
In 2021, Delaware increased the number of medical cannabis business licensees from three to six and all licenses have been issued.
In 2024, Delaware Governor John Carney signed HB 285 into law, expanding access to medical cannabis across the state, including waiving the requirement for a patient to have a debilitating medical condition to qualify for a registry identification card, allowing health care providers to decide whether a patient has a diagnosed medical condition for which they would recommend medical cannabis treatment, allowing patients aged 65 and older to self-certify their qualification for a medical cannabis identification card, and permitting individuals with out-of-state medical cannabis identification cards to make purchases in Delaware dispensaries.
House Bill 425 transitioned the Medical Marijuana Program from the Division of Public Health to the Delaware Office of the Marijuana Commissioner (OMC).
Recreational Cannabis
In April 2023, Delaware joined over 20 other states to legalize recreational cannabis use after House Bill 1 and House Bill 2 became law. The law allows adults aged 21 and over to possess up to one ounce of cannabis, or 850 milligrams of concentrated THC products. Retail sales will be subject to a 15% tax. The OMC has the authority to issue up to the following number of licenses:
- 20 cultivation licenses for each category of open, social equity and microbusiness.
- 10 manufacturing licenses for each category of open, social equity and microbusiness.
- 15 retail licenses, for each category of open and social equity.
- 3 open testing laboratory licenses.
- 2 social equity testing laboratory licenses.
In September 2024, regulations for the adult-use cannabis market in Delaware were finalized and published under the 5001 Rules of the Office of the Marijuana Commissioner.
Existing medical marijuana businesses in Delaware were allowed to transition to adult-use sales under House Bill 408. Thirteen existing dispensaries in Delaware applied for and were awarded adult-use licenses. The Delaware News Journal stated in February 2025 that all medical marijuana dispensaries have been issued conditional licenses to convert from medical to recreational sales, but they do not have active operating licenses yet and are not allowed to start adult-use cannabis sales.
According to the Delaware Marijuana Control Act Implementation Timeline, the OMC began accepting applications for all licenses on August 19, 2024, including open, social equity, and microbusiness licenses. The application window closed on September 30, 2024.

Three Social Equity Micro Cultivation and Micro Manufacturer each were awarded in Sussex County without a lottery because the number of applications matched the number of permits available. Also, no lotteries were held for testing laboratories because the number of applicants did not exceed the total number of available licenses – Kent and New Castle each had one Open Testing Laboratory license, and New Castle and Sussex each had one Social Equality Testing Laboratory license.
In December 2024, Delaware awarded 15 more recreational marijuana licenses to retailers through a lottery conducted by the state’s Cannabis Regulatory Agency.
The plan was to start recreational cannabis sales in March 2025 but conditional licenses cannot be awarded until a background check has been performed and there have been some complications in that process. On May 5, 2025, the OMC stated that it received a fingerprint service code from the FBI to perform required background checks on selected applicants and it is expected that this will bring the state closer to commencing the adult-use marketplace. In May 2025, a new Office of the Marijuana Commissioner was appointed and he has already begun to issue conditional licenses, after which a business has 18 months to become fully operational and receive its active license.
As of September 2, 2025, the OMC has issued 79 conditional licenses and 3 active licenses.
On July 1, 2025, the OMC announced that Delaware will start adult-use cannabis sales from August 1, 2025, with the first sales being made by the 13 medical cannabis dispensaries that have obtained the conversion licenses while the other 30 recreational retail licenses are still in the process of getting approved.
In September 2025, the OMC started to allow cannabis licensees to apply to transfer permits between Delaware’s counties under certain circumstances. For their reassignment to be considered, applicants must provide evidence of efforts to secure a location in the originally assigned county, proof of site control in the proposed new location, verification of compliance with all OMC location-based regulations, and zoning confirmation from the local government of the proposed site. This would allow certain licensed cannabis businesses to relocate to other counties when the regulations in their originally assigned county pose a barrier to establishing operations.

According to the state’s Medical Marijuana Program Annual Report, 23,779 patient cards were issued in 2022 – 21% up from 2021. In the fiscal year 2023, patient cards peaked at 27,904 but then fell dramatically to 15,709 patient cards in July 2024. In 2021, the state’s operations sold about $37.3 million in medical cannabis comparing to $27.7 million in 2020 – a 35% increase. In 2022, medical cannabis sales were estimated at $45.8 million.
In 2023, the total sales of marijuana products for the Delaware Medical Marijuana Program exceeded $53.8 million, according to the OMC 2023 Annual Report. In 2024, medical cannabis sales fell to $44.9 million according to the OMC 2024 Annual Report. This fall in medical cannabis sales can be linked to patients not renewing their patient cards and going to neighboring states to purchase cannabis.
