Online Cannabis Sales. Cannabis Non-Storefront Retailer License.

A cannabis non-storefront retailer sells cannabis goods to customers only through delivery and requires a physical commercial location to securely store on its premises cannabis and cannabis products that have been purchased at wholesale for eventual resale to consumers. Currently, cannabis Non-Storefront Retailer license is available in 4 states – California, Washington DC, Maryland and New York.

California

Adult-use and/or medical cannabis non-storefront delivery activities (Type 9 retail license) may only include the selling of adult-use cannabis from a non-storefront premises to an individual over the age of 21 or a qualified patient in compliance with State and local regulations within the State of California. Cities and counties may set their own rules, and some choose to ban the cannabis business.

Internet Retailer License permits businesses that do not have a physical location open to the public to sell cannabis and paraphernalia online and by mobile application for delivery to eligible patients. Deliveries are permitted to be conducted by either licensed third-party couriers or internet retailer staff.

Maryland

Adult-use cannabis businesses can apply for a micro-dispensary license, which would enable them to run a delivery service without having a physical storefront. The first of these licenses is set to be awarded by January 1, 2024.

New York

“Delivery-Only Location” means an Office-approved location, obtained by a CAURD licensee, from which the licensee fulfills delivery orders made by consumers. For the purposes of delivery transactions, licensees may only receive cannabis products from a duly licensed distributor, accept delivery orders online from customers who are twenty-one years of age and older, and deliver products to those customers from their approved location to the residential address location provided by the customer. In-person customer sales from the delivery-only location are not permitted.
