Cannabis couriers are allowed to deliver cannabis products to consumers and patients from cannabis retailers. Currently, cannabis courier service is legal in 8 states – Colorado, Connecticut, DC, Massachusetts, Montana, New Jersey, New Mexico and Utah.

Colorado

In 2019 Colorado legislators passed HB19-1234, effectively regulating cannabis delivery in the state. Delivery of both medical and recreational cannabis is allowed through a third-party fulfillment contractor. Delivery of medical cannabis began in 2020 and recreational cannabis in January 2021.

Connecticut

Delivery service licensees may deliver cannabis directly to a qualifying patient, caregiver, or consumer from the appropriate cannabis establishment —  either delivery from a retailer, hybrid retailer, or micro-cultivator to consumers, or delivery from a hybrid retailer or dispensary facility to patients or caregivers — but they are not licensed to sell cannabis directly to a qualifying patient, caregiver, or consumer.

DC

Permits the third-party delivery of medical cannabis, medical cannabis products, and paraphernalia on behalf of licensed retailers and internet retailers to eligible patients and their caregivers. Deliveries are required to be made to residential and commercial building addresses located in the District that are not on District government or Federal property or on public or private school grounds, with the exception of deliveries to individuals at colleges and universities who are 21 years of age or older.

Maryland

Through June 30, 2024, a registered ancillary business for delivery may deliver medical cannabis only as specified in COMAR 10.62.30.04. Adult-use cannabis businesses can apply for a micro-dispensary license, which would enable them to run a delivery service without having a physical storefront.

Massachusetts

In 2020, the Massachusetts Cannabis Control developed a delivery program. Cannabis couriers are allowed to deliver cannabis and cannabis products to consumers and patients from a Cannabis Retail Establishment or Medical Cannabis Treatment Center. Cannabis Couriers cannot store cannabis and cannabis products overnight.

Montana

The transporter license allows a business to transport marijuana and marijuana products between licensed marijuana business registered premises, including testing laboratories, or to medical registered cardholders. Transporters may not deliver to adult-use consumers.

New Jersey

A third-party delivery licensee may transport a consumer’s purchases of recreation use cannabis and related supplies from the retailer to that consumer.

New Mexico

A licensee may deliver cannabis products directly to a qualified patient who is at least 18 years of age, a primary caregiver or a reciprocal participant, or directly to a consumer who is at least 21 years of age. Payment for cannabis and cannabis products shall not be requested or received by a cannabis courier. Licensees shall only deliver cannabis products to the person who is identified by the retail cannabis licensee as an intended, authorized recipient.

Utah

Utah adopted a model that allows courier services to be involved so that patients all over Utah can order their product and have it sent.
